Who we are
Bookish Badger is a trading name. In this document “we”, “us” and “our” mean the person or business named as the seller in the Business details of our Terms of sale, Returns, Privacy notice and Contact us pages, trading as Bookish Badger. Those pages give the seller’s name, geographic address and, where they apply, company and VAT details. Every page gives our email addresses. We respect the rights of authors and other creators and expect members of the Site to do the same.
Sending a notice
If you believe material on the Site infringes your copyright, trade mark or other intellectual property rights, email our support address in the Business details with the subject “Copyright notice”, or write to the address on our Contact us page. Your notice should include:
(a) your name, postal address, email address and telephone number, and if you act for the rights holder, their name and your authority to act; (b) a description of the work or right you say is infringed; (c) the exact web address of each item on the Site you want removed; (d) a statement that you believe in good faith that the use is not authorised by the rights holder, its agent or the law; (e) a statement that the information in your notice is accurate and that you are the rights holder or are authorised to act for them; and (f) your physical or electronic signature (typing your full name is enough).
Notices sent in the format required by the US Digital Millennium Copyright Act are accepted.
What we do
We review each notice promptly. Where it is valid and the material appears to infringe, we remove the material or disable access to it, and tell the member who posted it, including the name of the complainant and the substance of the notice. If the material is a Book we sell, we may withdraw it from sale while we look into the matter with the author.
We may ask for more information, or decline to act on a notice that is incomplete or does not appear to be well-founded. We will tell you if we do.
If your material was removed: counter-notice
If you believe material you posted was removed by mistake or that you are entitled to use it, email our support address with the subject “Counter-notice”, including: your name, address and email; the material removed and where it appeared; a statement that you believe in good faith that it was removed by mistake or misidentification, or that you are authorised to use it, with your reasons; and your signature (typing your full name is enough).
We send the counter-notice to the person who complained. Unless they tell us within 10 working days that they have started legal proceedings, we may restore the material.
Repeat infringers
We close the accounts of members who repeatedly post infringing material, as our Community guidelines explain.
Other legal complaints
You can also tell us about content that you believe is defamatory, breaches your privacy or confidence, or is otherwise unlawful. Email our support address with the subject “Legal complaint”, giving your name and contact details, the web address of the content, what you say is unlawful about it and why, and anything that helps us assess it. Where it is a statement about you, tell us which parts are untrue or private. We will review the complaint, may contact the member who posted it, and will tell you what we decide. To report other content that breaks our rules, see our Community guidelines.
False notices
Do not send a notice or counter-notice you know to be false. Anyone who knowingly misrepresents that material infringes, or was removed by mistake, may be liable for the harm this causes.
